It's hard to explain when you find the right game for you. It's a little bit like falling in love.
Yes, the game is obviously dying

The support in Europe is so bad, that only the currently fully populated servers seem able to survive. That's more or less the case with WAR, unless I'm missing something.
I can't read what you're saying. The letters are not big enough.
Metalhead, have you been in a position of authority in the raiding guilds that have access to these gear? If you did, you'd know that the first priority is progress, not the gear themselves. But in order to have progress you need to work on your gear. Unfortunately, life as it is, you lose raiders down the line for whatever reason. And you have to replace them, in order to keep on having progress.
What you're suggesting is an ever closing circle of raiders and people that are barred access because their gear does not contribute to the progress as much as poaching from other raiding guilds would. In all honesty I would prefer a fresh player that would need some upgrades (but not a zero to max gear makeover) than go around canibalising the limited population of the remaining raiding guilds.
It's all about retention and how easy it is to keep the raiding alive by injecting new population into it. If there was a huge gap between raider and non-raider gear, you'd also see big gaps in progress as the raiding guilds would stall in order to elevate the new members up to their standards.
All in all, having comparable gear uptainable outside raiding actually helps the raiding guilds towards progress, in the not so unfrequent case of having to look for new recruits everytime they lose members due to casualisation.
